Tactics and Mechanism of Procuratorial Supervision on Enforcement of Property Punishment

刑事判决财产刑的执行难问题由来已久,而财产刑执行监督的乏力现状也是检察机关企图突破立新的难点。检察监督乏力的原因包括司法环境与机制性因素的影响、信息来源的被动性、财产刑适度问题监督不足、监督力量薄弱等。解决监督难问题,可从完善检察监督策略入手,拓展监督渠道、灵活执行方式以及诉讼化监督过程;同时建立健全以增强监督实效为目的的多部门信息共享与动态监督机制、纠正违法机制、人财物保障机制。

The law enforcement difficulty of property punishment in criminal judgement is a long standing issue in reality,which is also a difficult point for the procuratorial organ to break through by the way of supervision.The reasons of powerless supervision include influences of judicial environment and mechanism,passivity of information source,lack of supervision on moderation of property punishment and weakness of supervising power.The tactics improvement of procuratorial supervision should go first to solve this problem,that means to expand the supervision channels,make enforcement methods flexible and make supervision process like a litigation.Meanwhile,mechanism of information sharing and dynamic supervision,mechanism of rectifying illegal acts and safeguard mechanism of human and financial resources should be built.
