社区体育运动噪声污染的法律治理探析

Legal Governance of Noise Pollution in Community Sports

社区体育运动噪声污染已成为影响社区居民生活的突出问题,这也在逐步蚕食社区体育运动的正面价值。然而,对于社区体育运动噪声污染的学理研究甚少,举措良莠不齐。以此背景出发,归纳该问题的表现,从法规滞后、执法困境、救济困难、守法和权利边界意识淡薄、社区治理能力和资源供给不足等方面剖析其法律治理的困境。基于此,构建立法、执法、司法、守法、自治相结合的五维法律治理模式,即法律规范配置的完善、执法职责与手段的充盈、司法救济路径的畅通、环境教育的渗透、社区治理权责和治理资源的优化,力图摆脱以往单一规制或者放任的治理进路,搭建起一个综合性的法律治理平台。

Noise pollution in community sports has become a prominent problem affecting the lives of the community residents,which has influenced the communication of the positive values of community sports.However,there are few scientific researches on noise pollution in community sports.This paper summarizes the existing problem and analyzes the difficulties in its legal governance from the aspects of law and regulation,law enforcement,relief,law-abiding consciousness and boundaries of rights,ability of community governance and resource supply etc.A five dimensional comprehensive legal governance model combining legislation,law enforcement,justice,law-abiding and autonomy has been constructed for the perfection of the legal norm,for better law enforcement means,for reduction of the judicial relief cost,for building better legal environmental,and for strengthening governance power and responsibility of the community.
