近年来,非法集资犯罪案件数量剧增,一定程度上影响了社会稳定,同时也给司法机关和行政机关的认定带来了困难。总结近几年非法集资案件的基本情况,分析非法集资案件在罪与非罪、此罪与彼罪的司法认定,即罪与非罪主要是区分非法吸收公众存款罪和民间借贷问题,厘清"非法性""公开性""利诱性"和"社会性"的特征;对此罪与彼罪的界定问题,应着重分清是否"以非法占有为目的"。对涉案财产的处置,实践中主要有两种处置方式:公安机关先期处置方式和资产处置领导小组全面处置方式;理论上,有三套程序可供选择:行政处置程序、刑事诉讼程序和商法清算程序。通过总结比较,采用政府为主导的专案组形式更加贴近生活的需要。非法集资案件的司法认定,应遵循法律规定和把握"以非法占有为目的"的内涵;对于财产处置,应多部门协同合作解决群众上访问题。

In recent years,the number of criminal cases of illegal fund-raising has increased dramatically,which has affected social stability to some extent,and has also brought difficulties to the recognition of judicial organs and administrative organs.By summarizing the basic situation of the illegal fund-raising cases in recent years,analyze the judicial convictions of crimes in the illegal fund-raising cases on the basis of sin and non-crime,namely,the crime of non-collecting public deposits and the crime of non-government loans Clarify the characteristics of“illegality”“openness”“inducement”and“sociality”.The definition of this crime and other crimes focus on the distinction between“the purpose of illegal possession”.There are mainly two ways to handle the disposal of the involved property in practice:the early disposal of public security organs and the comprehensive disposal of the leading group of asset disposal;in theory,there are three sets of procedures to choose:Administrative disposal procedures,Criminal procedure and Commercial law liquidation procedures.By summing and comparing,we think that government-led task force should be adopted to be closer to the needs of life.In the case of illegal fund-raising,the judicial determinationshould follow the law and grasp the“illegal possession for the purpose of”the content;for the disposal of property,it should be multi-sectoral cooperation and solve the problem of petitions by the masses.
