"辱母杀人案"的一审判决结果几乎遭到网络舆论一边倒的质疑。究其原因,案件发生时的伦理情境在网络舆论倾向的形成中起着重要的影响作用。"辱母"与"警察不作为"这一特定的伦理情境不仅把于欢陷于两难选择,也刺激着公众的道德神经,影响着公众的道德认识与道德判断,对道德推理起着导向性的作用。因此,司法审判应考量案件发生时的伦理情境,以实现司法审判法律效果与社会效果的统一。

The first-instance judgment for the homicide case,where the suspect killed for revenging the victim who humiliated his mother,has aroused questionings.While analyzing the causes,it is believed that the ethical situation has influential function for the development of the internet-based public opinion.The ethnic situation making of“humiliating the mother”and“police inaction”not only put it in choice dilemma but also stimulated public morality sense,which affected the public moral interpretation and judgment and hence guided the wind of moral inference.Therefore,it is suggested to consider the ethical situation that judicial adjudication should consider to achieve the unity of judicial and social effect.
