摘要
近年来,随着电子商务的不断普及,第三方支付给消费者的日常生活带来便利的同时,也因为其独有的特性使消费者的权益受到侵害。第三方支付存在的主要问题有:消费者知情权受侵害、消费者个人信息遭泄露、消费者资金安全得不到保障等。我国可借鉴美国、欧盟法律规定的相关经验,通过制定安全评估准则和技术安全标准、完善信息披露制度、完善个人信息保护制度、构建未授权支付的责任制度、建立第三方支付消费者保障险与保障金制度等措施来保护消费者合法权益。
In recent years,with the increasing popularity of Internet e-commerce,the third-party payment process brings convenience to the daily lives of consumers.However,its unique character may infringe the consumer’s interest.The main problems include the right to know,personal information leaking,and capital security.It is suggested to learn from the experiences of the USA and EU where the main practices include making security evaluation standard,improving the system for personal information leaking,completing the system for personal information protection,developing the liability system for unauthorized payment,establishing the security system for the third-party paying to protect the consumer’s right.
