家庭财产是家庭共同体的物质基础,家庭财产制度旨在保护人类的生存繁衍活动,注重维持家庭共同体的存续与功能,由家长主导财产运行,亲属依据伦理关系获得财产利益。家庭财产领域遵循特殊规则,依身份联系设计财产权利体系,家庭中的财产不可明晰,成员只享有抽象份额,按照需要配置财产利益,个人财产处分自由受限。家庭财产秩序嵌入于伦理秩序,物权法和婚姻法规定存在冲突之时,应该优先适用婚姻法规则。家庭财产规则不宜与物权法简单接轨,物权法定主义在婚姻家庭领域应保持谦抑特性,在夫妻财产领域中应正确适用不动产登记公示原则,不宜机械适用登记生效主义;善意取得涉及家庭唯一居房时,宜考虑家庭成员生存权和夫妻双方意志。
