近年来非法代孕产业的出现,给我国法律带来冲击,由非法代孕而衍生出的一系列代孕所生子女法律地位认定及监护权归属纠纷亟待解决。在此,笔者以我国首例代孕所生子女监护权归属纠纷一案为切入点,借助构建"克隆羊多利"式代孕模型,通过多角度分析认定代孕所生子女的法律地位,基于儿童利益最大化这一基本保障原则,兼顾代孕合同中代孕条款的效力分析,对代孕所生子女的监护权归属这一问题进行剖析,归纳代孕所生子女监护权纠纷的法律解决途径。

The illegal new industry of surrogacy surged in these years袁whcih brings big impact to the law袁and causes a series of disputes concerning the legal stauts determination and custody ownership of the surrogacy children.With the dispute of custody of the first surrogacy child in China and the building of the野Dolly冶model袁the thesis analyzes the legal status of the surrogacy children in many aspects by combining with the child benefit maximization principle and the effect of the surrogacy contract and summarizes the legal solution to the dispute of surrogacy child custody.
