摘要
TPP在美国奥巴马政府的强力推动下于2016年2月正式签署,其第十七章专门规定了国有企业和指定垄断制度,对国有企业参与商业活动提出了更高的要求和标准。TPP国有企业规则对国有企业的现行制度提出了前所未有的挑战,将会对今后的国际贸易和投资规则产生巨大影响。在TPP国有企业规则的提出和美国特朗普政府退出TPP的背景之下,分析TPP国有企业规则的理论基础、TPP国有企业规则对竞争中立的强化,界定国有企业规则概念及适用例外,解构非商业援助制度、透明度要求、清晰管辖权和公正监管相关概念,总结TPP国有企业规则对我国的影响及对策,将TPP国有企业规则带来的挑战转化为机遇,完善竞争法和竞争政策,对我国国有企业进行改革,才能不断增强我国国有企业的竞争优势。
The TPP was officially signed by the Obama administration in the United States in February 2016.Chapter 17 of the TPP specifically stipulates the state-owned enterprises and the designated monopoly system and sets higher requirements and standards for state-owned enterprises to participate in commercial activities.The TPP state-owned enterprise rules pose an unprecedented challenge to the current system of state-owned enterprises and will have a huge impact on future international trade and investment rules.Under the background of the proposed TPP state-owned enterprises and the withdrawal of the US Trump administration from the TPP,this paper analyzes the theoretical basis of the TPP state-owned enterprise rules,the strengthening of competition neutrality by the TPP state-owned enterprise rules,the definition of state-owned enterprise rules and the applicable exceptions,Commercial assistance system,transparency requirements,clear jurisdiction and fair supervision related concepts,summed up TPP state-owned enterprise rules impact on our country and countermeasures,the TPP state-owned enterprise rules challenge into opportunities,improve competition law and competition policy,to our country.Only when state-owned enterprises carry out reforms can we continuously enhance the competitive advantages of our state-owned enterprises.
