On Legal Foundation of Enactment of the Measures for the Administration of Balancing Accounts and Its Compatibility with the Higher Level Laws

在新一轮电力体制改革的背景下,输配电价改革作为近期推进电力体制改革的一个重点任务需要相关配套措施加以落实。在输配电价改革试点地区,设立平衡账户是电网企业应对电力市场风险的重要措施,是推进输配电价改革的客观要求,制定平衡账户管理办法具有紧迫性。本文全面论述了制定平衡账户管理办法的法律依据以及其中涉及的相关内容的合法性,认为该办法的制定无论是形式上还是内容上均具有坚实的法律基础。

Under the background of the latest round of reform of electric structure,the reform of transmission and distribution prices as a key short-term task of pushing forward the reform of electric structure,requires supporting measures to be implemented.In the pilot areas of reform of transmission and distribution prices,the establishement of balancing accounts is an important measure for grid companies to cope with the risks of power market,and an objective requirement for pushing forward the reform of transmission and distribution price,so it is urgent to enact the Measures for Administration of Balancing Accounts.This paper gives a comprehensive exposition of the legal basis of the enactment of the Meaures for the Administration of Balancing Accounts and the legality of relevant contents of it with the conclusion that the enactment of the Measures has a solid legal foundation both in form and in content.
