法治指数作为评估当地法治状况而兴起的一种实践法学研究方式,俨然已经成为当下理论界和实务界关注的热点问题之一。以量化分析为基础的社会学在法学中的发展和运用,为法治指数实践的诞生与兴起奠定了方法论基础;现代社会普世性法律价值的相对可确立性,为法治指数实践在世界范围内的发展奠定了价值论基础。法治指数量化可以较为客观地反映地方法治建设的现状,各地逐步开展的法治指数建设已经成为推进中国法治建设的有效模式,成为完善我国地方法治建设的助推器。法治指数在当今中国被赋予了特别的意义,各地区不断开展的地方法治建设离不开法治评估体系的量化考察,法治指数已经成为各方政府推动法治发展的重要方式和手段。法治指数的评估不仅要考虑到普适性和多元性,尤其是在建立地方法治指数评价体系时还需要注意形式法治与实质法治、全球规律与本土资源、法治状况与社会发展的有效统一。

The rule-of-law index,as a path to researching the practical law of evaluating local rule-of-law conditions,has become one of the hot issues in the theoretical and practical circles.Sociology employs the quantitative analysis as its basis,and its progress and application in jurisprudence laid the foundation of meth-odology for the birth and development of rule-of-law index.Meanwhile,the relative accountability of universal value of law in modern society takes the value basis for the worldwide progress of rule-of-law index.The quan-tification of the index can reflect the status of the local construction in rule of law objectively,and in every part of our country,the rule-of-law index is being built,forming an effective mode for propelling our rule-of-law progress and improving this construction in each region.The index has been endowed nowadays with special meanings in China.All the areas are launching the rule-of-law campaign and cannot examine it without the quantitative evaluation system.Therefore,the index comes to be a vital mode and method to enhancing rule-of-law progress.Its evaluation also needs to fuse universality and pluralism,and when establishing the evaluation index system of local rule of law,we should pay attention to the effective unification of formal and substantive rule of law,global law and local resources,rule of law and social development.
