摘要
在法理上对教师惩戒权进行探讨的基础上,对教育实践中教师对中小学生不良行为和严重不良行为的惩戒困境进行分析。域外国家和地区对教师惩戒权的相关法律规定及其行使原则为我国对教师惩戒权的规制提供了有益借鉴和启示,即教师惩戒权的权威性、明确性、规范性在法律中都要有规定。在此基础上,提出明确教师惩戒权的行政权力性质、注重教师惩戒权行使的程序规范、强化教师惩戒权的教育性原则和完善教师惩戒权的法律监督体系等建议。
This article analyses the disciplinary difficulty on the bad behavior and serious bad behavior of primary and secondary school children on the basis of clear definition on the disciplinary power of teachers.The relevant legal provisions and principles of the punishment right of teachers in developed countries and regions provide useful reference and inspiration for the regulation of teachers' disciplinary power in our country.On the basis of comparative study on those laws and rules abroad,this article puts forward four suggestions:clearly empowering teacher the disciplinary power,regulating the procedural matter on using disciplinary power,focusing on the educational principle of the power and improving supervision system on the power.
