以公民政治权利视角论宪法中的受教育权

On the right to education in the constitution from the perspective of civil political rights

国家对于公民的权利和义务的保障所承担的责任是有所不同的。虽然《宪法》第四十六条规定,我国公民享有接受教育的基本权利及义务,但并不等同于接受教育既是公民的权利,亦是公民的义务。厘清受教育权之前的权利义务关系,有利于更好地保障公民宪法层面的受教育权。结合《宪法》第二章整体,受教育权应当是公民享有的一项没有附带义务的基本权利,在我国人民代表大会的根本政治制度下,公民需要恰当地接受教育才能有效地行使政治权利,保障公民受教育权符合我国的宪法目的。

The responsibilities of the state for the protection of the rights and obligations of citizens are different.It is stipulated in Article 46 of the Constitution that the citizens of China enjoy the fundamental rights and obligations to receive education.But it does not mean that the acceptation of education is both rights and obligations of citizens.Considering the second chapter of the Constitution,the right to education should be a fundamental right without accessory obligations,under the fundamental political system of China People s Congress,citizens need to be properly educated to effectively exercise their political rights so as to guarantee citizens'rights to receive education conforming to the constitutional purpose of China.
