中国加入WTO过渡期满后的“市场经济地位”问题探讨

Discussion on the “Market Economy Status” after the Transition Period of China's Entry into WTO

随着中国加入WTO过渡期满,如何根据《中华人民共和国加入世界贸易组织议定书》第15条的规定争取我国应有的权利已成为当务之急。文章共分为五个部分对中国加入WTO过渡期满后的"市场经济地位"问题进行探讨:一是探究了WTO规则中关于中国加入WTO十五年"非市场经济地位"的规定及其由来;二是介绍了各世界主要经济体关于"市场经济地位"认定的法律规定;三是分析了当前世界各国对我国获得"市场经济地位"的态度;四是对《中华人民共和国加入世界贸易组织议定书》第15条进行解读,得出我国应当在十五年期满后自动取得"市场经济地位"的结论;五是面对当前仍有部分经济体否认我国"市场经济地位"的国际态势,提出三个方面建议。

With the expiration of the transitional period of China's accession to the WTO,how to win the right of our country according to the fifteenth item of China's Accession Protocol has become a top priority.This paper is divided into five parts to discuss the“market economy status”after the transition period of China's entry into WTO:First of all,this article explores the provisions on the Chinese joined WTO fifteen years of“non market economy”and its origin in the WTO rule.Secondly,this paper introduces the legal provisions of the world's major economies on the identification of“market economy status”.Thirdly,this paper analyzes the attitude of all countries in the world to China’s“market economy status”.Fourth,the article on the interpretation of the“Protocol”Chinese WTO fifteenth,come to our country should automatically acquire“market economy status”in the fifteen years after the expiration of the conclusion;finally,in the face of the current economy there are still some deny that China's“market economy status”of the international situation,the article puts forward three suggestions.
