旅游合同有其特殊性,关于旅游合同违约的精神损害赔偿目前存在很大争议。文章通过司法案例分析我国旅游合同违约的精神损害赔偿方面存在的法律问题,借鉴其他国家或者地区的相关立法和司法实践,提出建立我国旅游合同违约精神损害赔偿制度的建议,供有关专家学者参考。

Tourism contract has its particularity,and there is a great deal of dispute about the compensation for spiritual damage in breach of tourism contract.Based on the analysis of the legal problems of our spiritual damage compensation in breach of tourism contract through judicial cases,reference to the relevant legislation of other countries or regions and the judicial practice,proposed the establishment of China's tourism spirit of breach of contract damages system,relevant experts and scholars for reference.
