摘要
法律学习的困境需要从法学思维能力寻求破解之法,而法律思维能力训练的前提即是明确的体系构建。法律思维能力的三阶体系,以基本的法律概念与法律价值为骨架,以法律人的逻辑推理方式为脉络,以实践与理论并行的联想运用能力为血肉。基于此法律思维能力的三阶体系,培养法律思维能力的方式有:抓住基本价值概念法、二重分法、思维导图法等方法。
The dilemma of legal learning needs to be solved from legal thinking ability,while the premise of the cultivation of legal thinking ability is a clear system construction.The third order system of legal thinking ability takes the basic legal concepts and legal value as the skeleton,and the logical reasoning of the legal person as the context,the associative use ability with practice and theory parallel as the flesh and blood.Based on the threeorder system of the legal thinking ability,the method of developing the legal thinking ability is to grasp the basic value concept,the double division method,the mind mapping method and so on.
