From Administrative Logic to Dimension of Judicature:Clear Picture of System of Judges' Meeting Based on Sample of Function “Weakening” and “Alienation”

我国法官会议制度在审判实践中存在功能"弱化"与"异化"的双重困境:被"架空"致使咨询与统一裁判尺度的效果不理想,或被"滥用"异化成法院内部的审判决策组织。根源在于该制度运行背后行政化的异化逻辑,表现为组成机制、启动机制、发言机制的高度科层化以及会议决议影响独立裁判等。我国法官会议制度应转变会议运行理念,坚持效益原则,改造功能维度、规则维度和运行维度,推进审判权运行扁平化。
