中国大陆地区道路交通事故责任立法司法的基本状况及评价

The Basic Legislative and Judicial Situation of Road Traffic Accident Liability in China's Mainland

中国大陆地区的道路交通事故责任法,是由《道路交通安全法》《侵权责任法》以及最高人民法院有关司法解释和有关行政法规组成的体系。其基本规则是在机动车责任强制保险赔偿不足的部分,用《侵权责任法》的规则,确定机动车交通事故的责任分配。目前存在的主要问题:一是机动车交通事故责任保险赔偿数额过低;二是有些责任规则不尽完善;三是对于自动驾驶汽车交通事故责任规则正在探讨中,尚未有成型的规则,需要进行进一步的研究。

The legal structure of road traffic accident liability in China's Mainland is made up of Road Traffic Safety Law,Tort Law,judicial interpretation of the Supreme People’s Court and some relevant administrative regulations.The basic idea is that when the compensation of compulsory liability insurance is insufficient,we can use the rules of the Tort Law to determine the liability allocation of road traffic accident.Some current problems are as follows:first,the amount of the compensation of compulsory liability insurance is too low.Second,some rules are not perfectly regulated.Third,the road traffic accident liability rules for the autonomous cars are still under discussion and now there are no systematic rules for that,so further research is still needed.
