摘要
《中华人民共和国物权法》(下文简称物权法)第一百零六条已经明确规定了善意取得的构成要件,《物权法》若干问题解释(一)也进一步释明了对善意取得具体要件的认定标准;可以看到,法律以及司法解释的相继出台,使得善意取得这一重要理论在司法实践中的适用标准更加明晰。然而,在司法实践的部分个案当中,对善意取得具体要件的认定却依然存在着与现有法律规定不相统一的现象。为进一步明确法律规范在民事案件中的教育、指引作用,增强法律的规范作用及适用性,本文将以对一个实务案例的判决结果的分析为起点,论述善意取得部分构成要件在该案中适用的欠妥性,以达到明晰善意取得的构成要件在实践中的适用标准之目的,增强善意取得的适用性。
Article 106 of“The Property Law of the People's Republic of China”(hereinafter referred to as the"Property Law")has clearly stipulated the elements of Bona fide acquisition,and the explanations of several issues in the“Property Law”(1)have further clarified the criteria for obtaining specific requirements for Bona fide acquisition;It is clear that the application of law and judicial interpretation has made the application of this important theory of justice in judicial practice more clear.However,in some cases of judicial practice,the recognition of the basic theory of Bona fide acquisition has still existed something which are not consistent with the regulations of laws.In order to further clarify the legal norms in civil cases,and enhance the normative role and applicability of the law.This paper will start with the analysis of the judgment result of a practical case,discussing some error in the application of the elements of the legal norms in the case.Then,re-analysis the elements of Bona fide acquisition in order to enhance the applicability of it.
