摘要 互联网直播行业爆发式增长过程中,越来越多的直播产品开始开发直播答题功能、进一步吸引用户关注。直播答题模式本身与传统媒体的"知识答题、益智答题"相似,但形式更为复杂、多样,其引发的社会问题通过互联网放大后影响更为广泛,相关法律认定等问题也更为复杂。虽然根据国家工商总局等相关机构的回复及既往司法裁判,就直播答题是否属于销售行为、是否构成有奖销售问题,可以得出肯定回答;但直播答题是否属于抽奖式有奖销售、是否受到奖金不得超过五万元的限制,监管界及学术界仍莫衷一是。研究直播答题涉及的有奖销售问题,对厘清监管思路、规范直播行业合法运营,具有重要意义。 In the explosive growth of the Internet live streaming industry,more and more applications are beginning to develop live quiz show to further attract attention.Live quiz show is similar to traditional quiz show in many ways,but its forms are more complex and diverse,so the social problems caused by it are more extensive after being amplifi ed by the Internet and related issues such as legal identifi cation are also more complicated.Although according to the State Administration of Industry and Commerce and former judicial decisions,affirmative answer can be obtained about whether the live quiz show pertains to lottery-attached sale,but if it is lottery-attached sale in form of lottery-drawing and subject to the limit of RMB 50,000 still remain unsettled.Thus the research on lottery-attached sale issues involved in live quiz show is of great signifi cance in clarifying the supervision principles and regulating the legitimate operations of the live streaming industry.
