邻避冲突的利益解构与衡平——以庞德利益理论为视角

Deconstructing and balancing of the interests in the NIMBY conflict from the perspective of Pound 's interests theory

工业化、城市化进程的加速催发出现代社会日益频繁的邻避冲突现象。从利益视角看,邻避设施建设引发的利益失衡是导致邻避冲突的主要原因。以庞德的利益理论作为分析工具,可将邻避冲突中的主要利益划分为个人利益、社会利益和公共利益。破解邻避困局的关键在于衡平利益关系,依循庞德利益衡量的价值准则,应以最小的利益牺牲实现整体利益的最大化,因而需要重构邻避项目实施的利益衡量机制,完善相关法律法规,转变行政管理模式,健全利益补偿制度。

With the development of industrialization and urbanization,the phenomenon of NIMBY conflict in our society is increasingly frequent.From the perspective of interests,the imbalance of interests caused by the construction of public facilities is the main reason of the NIMBY conflict.Taking Pound's interest theory as a diagnostic tool,we can find that there are individual interests,public interests,and social interests in the NIMBY conflict.The key to solving the NIMBY conflict is the balancing of interest.We should stick to maximum interests by sacrificing minimum interests according to Pound's value criterion of interest measurement,therefore,it is necessary to reconstruct the benefit measurement mechanism for the implementation of the NIMBY projects,improve the relevant laws and regulations,change the mode of administrative management,and improve the system of benefit compensation.
