On Application of the Separable Rule of Works of Applied Art-from the Perspective of Merger Doctrine

实用艺术作品的认定是困扰著作权理论与实践的难题。实用艺术作品的认定遵循分离规则,即艺术成分可以区分于实用功能并独立存在。分离规则的产生并非偶然,而是由思想表达二分法中的合并理论衍生而来。为了确保该规则的准确适用,应当立足于合并原则适用"观念分离"的标准,并对实用艺术作品的"分离性"与"独立性"进行认定。

The identification of works of applied art is a puzzle that plagued the theory and practice area of copyright.The identification of works of applied art follows the separable rule which means art components can be distinguished from useful function,and exist independently.The foundation of the separable rule lies on the Idea-Expression Dichotomy and Merger Doctrine.In order to apply the rule accurately,we should adopt the“conceptual separation"standard,based on the Merger Doctrine,and grasp the meaning of"independence"and"separation".
