“三权分置”背景下土地流转的基础模式与农业规模化经营

农村土地所有权、承包权与经营权三权分置是今后农村土地产权制度改革的主要方向,也是推进农业规模化经营的重要制度条件。"三权分置"背景下,土地经营权流转将成为未来农地流转的基础模式,即通过土地经营权的流转以实现土地的"成方连片",农户对承包权的保有以实现财产性收益。从法理上,以"经营权流转"为基础的流转方式能够适应家庭农场、龙头企业、农业股份合作社、土地信托等典型的农业规模化经营模式,也能够化解在农业规模化经营中,土地流转与农民失地这一矛盾。
