新时代背景下我国经济法综合立法的思考

Consideration on the Comprehensive Legislation of Economic Law in China in the New Era

实行科学有效的经济法治,既是不断深化我国经济体制改革的内在要求,也是积极主动适应经济新常态的现实诉求。全面推进依法治国,为经济法的综合立法提供了难得的历史机遇。在此过程中,要克服阻碍经济法综合立法进程的种种障碍,通过从经济法的分散化立法到经济法的综合立法转变。制定经济基本法,从注重经济领域硬法的制定到经济领域的硬法与软法协同发展,从侧重经济领域实体法的制定到经济领域的实体法与程序法平衡发展,从多个维度实现经济法的综合立法。经济法的综合立法,有助于解决经济新常态下所涌现出的新问题、新挑战,不断优化经济结构、助推经济增长,引领和规范经济新常态下的经济转型与经济创新进程,促进国家治理体系和治理能力现代化。

Scientific and effective economic rule of law is not only the internal requirement of deepening the reform of China’s economic system,but also is to actively face the reality of the new normal economic demand.To comprehensively promote the rule of law provides a rare historical opportunity for the comprehensive legislation of economic law.In this process,to overcome the obstacles hindering the process of comprehensive legislation of economic law,through the economic law from the decentralized legislation to the unified legislative transformation of economic law,that is,the formulation of economic basic law,from focusing on the formulation of the hard law in the economic field to the coordinated development of the hard law and soft law in the economic field,from focusing on the formulation of substantive law in the economic field to the balanced development of substantive law and procedural law in the economic field,from multiple dimensions to achieve comprehensive legislation of economic law.The comprehensive legislation of economic law will help to solve the new problems and challenges emerging in the new normal economy,optimize the economic structure,promote economic growth,lead and standardize the process of economic transformation and economic innovation under the new normal economy,and promote the modernization of national governance system and governance capacity.
