非专利实施体标准必要专利诉讼中禁令的适用原则

Applicable Principles of Injunction in the Case of Standard-Essential Patents by Non-Practicing Entity

随着高新产业的发展与专利标准化的普及,越来越多非专利实施体请求法院向标准必要专利侵权人颁发禁令。目前,各国法院对禁令的适用原则不一致,主要适用衡平法原则、FRAND原则和过错责任原则。学界则多从反垄断法与反不正当竞争法视角论述,对象相对单一。禁令适用标准成为最近饱受争议的话题,而禁令制度影响着企业的发展和技术的革新,因此法院在适用禁令时当以善意原则、FRAND前置原则、利益平衡原则及禁令最后救济原则进行综合考察。

With the rapid development of high-tech industries and the prevalence of Standard-essential Patents,an increasing number of Non-Practicing Entities are seeking an injunction against infringer in the court.Applicable principles of injunctive relief include balancing of interests,FRAND and the principle of fault liability among different courts.In the academic circle,the principles are mostly in the view of the Anti-monopoly Law and Anti-unfair Competition Act.Since the standard of injunctive relief becomes a contentious issue in the world,which affects the development of enterprises and technology,it is of importance for courts to adopt the applicable principles of injunctive relief including good faith,FRAND,balancing of interests and final injunctive relief.
