制定单行条例规范民族自治地方城市管理的问题研究——以北川羌族自治县城管立法为例

Study on Problems in Formulating a Separate Regulations to Regulate Urban Management in Autonomous Areas of Ethnic Minorities:Taking the City Management Legislation of Beichuan Qiang Autonomous County as an Example

民族自治地方制定单行条例,依法规范城市管理综合行政执法工作,具有充分的必要性,同时也是立法上的新探索。城管单行条例在立法定位上以"小城管"立法为宜,即围绕城管综合行政执法来展开。在立法功能上,城管条例旨在承接上位法,合理进行细化、补充、变通。城管单行条例发挥立法变通权,设立行政处罚,不仅具有法律依据,同时符合法理和立法目的。同时,条例的实施依赖具有正式编制和执法资格的城管执法人员,民族地区应采取积极措施,缓解"执法人员荒"的困境。

It is necessary for ethnic autonomous areas to formulate separate regulations and regulate the comprehensive administrative law enforcement in accordance with the law,which is also a new exploration in legislation.The single line regulations of urban management are suitable for the legislation of"small city management"in the legislative orientation,which is to begin with the comprehensive administrative law enforcement of urban management.In the legislative function,the urban management regulations are designed to undertake the upper law,which is reasonable to refine,supplement and adapt.The unilateral regulations of urban management play the right of legislative change and establish administrative punishment,which not only has legal basis,but also conforms to legal and legislative purposes.At the same time,the implementation of regulations depends on the urban management and law enforcement personnel who have formal preparation and law enforcement qualification.Minority areas should take positive measures to alleviate the plight of"shortage of law enforcement personnel".
