安全生产与职业卫生一体化监管执法对策研究

Study of Countermeasure for the Supervision and Law Enforcement of Safety Production and Occupational Health Integration

对比国际劳工组织和许多发达国家的经验,认为我国安全生产和职业卫生监管执法存在诸多问题,需要从国家层面战略目标框架、立法层面两法合并、职业安全卫生法律法规标准体系完善、监管执法主要任务方面,通过运用专家头脑风暴法的质疑方式,重新设计一体化监管执法体制机制,并就此提出安全生产与职业卫生一体化监管执法对策措施,包括执法队伍、奖惩制度、执法检查、风险管控、宣教培训、技术服务等一体化。

Compared with the experience of International Labour Organization and many developed countries,there are many problems in China’s production safety and occupation health supervision and law enforcement.By consulting experts’opinion by the method of expert investigation of questioning brain storming,this paper redesigns the system mechanism of integrated supervision and law enforcement from the national level,strategic framework on the legislative level,the implementation of the merger of the two laws,improve the occupation health and safety standard system of laws,and regulations to the main tasks of safety production and occupational health supervision and law enforcement.And it puts forward countermeasures for the supervision and law enforcement of safety production and occupational health,including law enforcement personnel,reward and punishment system,law enforcement inspection,risk management,education training,and technical services integration.
