民国时期国民政府的合作社立法研究

Cooperative Legislation of the National Government in the Period of the Republic of China

民国时期,国民政府的中央部门及所属的地方政府诸多部门,为推动发展合作社经济,针对不同时期的具体情况,相继颁布一系列法令章程,形成较为系统完整的合作法规体系。相关合作法规的制定与实施,保证了国民党政府发展合作社经济各项政策的实施,规范并推动了合作社的发展,以此支持了抗战并促进了乡村社会经济变迁,同时也为台湾时期国民党的合作社立法积累了丰富的经验。但国民政府和在不同阶段颁布的合作社法规有互相抵触之处,其内容的规定既存有背离合作社原则的方面,也在强调完备的同时伴有繁琐的状况发生,由此导致其诸多法规在当时的历史条件下难以彻底实行。

During the period of the Republic of China,according to the specific condition of different periods,in order to promote the development of cooperative economy,the central departments and subordinate to the local government department of the national government successively promulgated a series of statutes and forms relatively systematic and complete cooperation regulations system.The formulation and implementation of relevant laws and regulations about cooperation ensured the implementation of developing cooperative economy policies of the nationalist government,and promoted the development of cooperatives to support the Anti-Japanese War and promoting the rural social and economic change,as well as accumulated rich experience during the period of the cooperative legislation in Taiwan.But there were resistance about cooperatives regulations which were issued by the national government at different stages,and the regulation of its content not only deviated from the cooperative principle,but also emphasized the occurrence of the complete complicated conditions at the same time,thus causing many rules and regulations was difficult to implement thoroughly during the period of the historical condition.
