论中华民国法学会研究的构想

On the Research of the Law Society in the Republic of China

中华民国法学会以研究法学、改进法制为目的,是一个在二十世纪三四十年代中国具有较大影响的法学研究团体。它所提倡的新法学思想,特色突出;它对树立法治国家的基础要点,独树一帜。通过梳理中华民国法学会的机理及其活动,呈现一个具有特色的法学研究团体全貌,对于了解民国时期学术、社团、社会等因素的相互作用是有益的。对中华民国法学会的研究,需要在对既有研究展开学术综述、评价其利弊得失的基础上,提出研究内容与研究思路。

The Law Society of the Republic of China aimed to study law and improved the legal system,which was a legal research group that had a great influence on China in 1930s to 1940s.It had prominent features,advocating the new legal thought,and was unique for the establishment of the rule of law in the country.By combing the mechanism and activities of the Law Society of the Republic of China,and presenting the unique legal research group,it is beneficial to understand the interaction of academics,social activity,society and other factors in the Republic of China.Based on the existing academic research and evaluation of its pros and cons,the paper puts forward the content and ideas of the research of the Law society in the Republic of China.
