摘要
目前,国家对于房地产行业的调控不断趋于严格。愈发细化、规范的调控政策,倾向明显的供地总量以及单项土地供应规模的控制,日趋合理的土地供应结构调整等,都潜移默化地推进着房地产业的发展迈入规范化轨道。然而,对于房地产企业而言,伴随着调控力度的不断加大,取得项目用地的难度逐步加大,面临的法律风险日益递增。在贯彻依法治国的方针中,如何在法律层面上确保房地产开发企业在取得土地使用权时合法合规,成为房地产企业在新时代面临的重要问题之一。
At present,the control of the real estate industry from the state tends to be strict.More detailed and normative regulation policy,the control of the total and individual land supply scale and more reasonable land supply structure adjustment,etc.,are subtly promote the development of real estate into standardized track.However,in the case of real estate enterprises,with the strict adjustment of regulation,the difficulty of getting project land becomes increasingly difficult and the legal risks are increasing.Along with the advancement of the strategy of the rule of law principle,how to ensure that the real estate enterprise development in the legal level and obtained the right of land use in legal compliance become an important issue for the real estate enterprises.
