基于银行实务视角下完善票据业务制度的政策建议

Policy Suggestions on Perfecting Negotiable Instruments System from the Perspective of Banking Practice

我国现行的票据业务法规制度体系是由《中华人民共和国票据法》、《最高人民法院关于审理票据纠纷案件若干问题的规定》、《票据管理实施办法》、《支付结算办法》以及中国人民银行、银监会发布的有关票据业务的规范性文件组成,这些法规制度基本是在1996年——2005年间制定的,相比票据业务发展,已经严重滞后。票据业务的创新发展,对现行票据制度的完善提出了迫切要求。文章认为制度漏洞导致票据实务无法可依,监管弱化,甚至发生票据案件,即使目前无法完成《票据法》的修订,也要及早根据票据实务中出现的问题,制定或修订票据规范性文件,以防范各类风险,保障票据业务健康发展。

The current system of regulations and rules for Negotiable Instruments in China is composed of Law of the People's Republic of China on Negotiable Instruments,The Provisions of The Supreme People's Court on Several Issues in the Trial of Negotiable Instruments Disputes,Negotiable Instruments Law of the People's Republic of China,Payment and Settlement Method and the normative documents issued by the People's Bank of China and the Banking Regulatory Commission concerning Negotiable Instruments.These laws and regulations were basically formulated between 1996 and 2005.Compared with the development of the Negotiable Instruments,they have seriously lagged behind the innovation and development of Negotiable Instruments.As a financial practitioner,the author believes that the loopholes in the system lead to no legal basis for Negotiable Instruments practice,the weakening of supervision and even the occurrence of Negotiable Instruments cases,even though the revision of the Negotiable Instruments Law cannot be completed at present.In order to prevent all kinds of risks and ensure the healthy development of Negotiable Instruments,it is necessary to formulate or revise the normative documents of bills as early as possible in accordance to the problems in Negotiable Instruments practice.
