无形财产权体系论纲——基于信息及其活动无形的建构

Outline of Intangible Property System——Based on Construction of Information and Intangible Activities

无形财产权并非是指权利本体的无形,而是基于权利客体,即知识意义的无形。知识与信息在本质上是一致的,只是信息概念比知识概念更本源、更基础。无形财产权体系的构建应以信息及其活动为基础,涵摄基于创生信息的知识财产权、基于评价信息的资信财产权以及基于信息活动的服务财产权。在无形财产权体系的外部协调方面,我国民法典宜设财产总则编,对包括有形财产权和无形财产权在内的绝对性财产权,和以债权为典型的相对性财产权作出一般规定。

The intangible property right is the intangible state of the right's object,not the intangible state of the right's ontology.It lies in the invisible significance of knowledge.Knowledge is essentially consistent with information.But the concept of information is more primitive and more basic,compared with the concept of knowledge.The construction of intangible property system should be based on the information and relative activities,including intellectual property rights based on information creating,credit information property rights based on evaluation of information and the service property rights based on information activities.The general provisions of the property should be established in the our nation's future Civil Code,which regulates absolute property rights including tangible property rights and intangible property rights and the relative property rights,creditor's rights as a typical example,so as to deal with the external relations of the intangible property rights system.
