摘要
随着"一带一路"倡议的实施,培养高质量的涉外型法律人才是法学教育面临的重大课题。案例教学法作为"国际私法"课程教学的重要教学方法之一,存在着案例的本土化缺失和"例证"化现象等诸多问题,难以达至课程教学目标。在应用型法学本科"国际私法"案例教学中,构建基于"问题中心主义"之案例教学法契合培养学生法律思维、法律职业能力等课程教学目标。构建基于"问题中心主义"之案例教学法,以完善教学内容和教学体系的模块化、系列化为前提;以构建类型化、系列化、本土化案例库为基础,充实案例教学法的案例材料;以原告诉权为起点,通过问题的发现、预设、解决等问题驱动手段,探索法官判案的思维路径及其相关法理,培养学生的法律职业能力,实现应用型法学人才培养目标。
With the implementation of the"belt and road initiative",the training of high-quality foreign-related law talents is a major issue facing the law education.As one of the important teaching methods of private in?ternational law,case teaching method has many problems,such as the lack of localization of cases and the phenomenon of"exemplification",which makes it difficult to achieve the teaching objectives.Therefore,in the case-based teaching of private international law,the case-based teaching method,which is based on the"problem centralism",fits the case-based teaching goal of the cultivating students'law thinking ability.Improving the content and system of teaching with its modularization and serialization as premise to construct the case library with the type,serration and localization can provide the teaching materials for the case teaching method.Taking the plaintiff’s litigious right as the starting point,through the problem-driven method such as the problems’discovery,problems’design and problems’solving,etc.,this paper explores the way of the judges’law thinking and its related law theory,in order to develop the students'ability of law professional competence,and realize the target of the cultivating the applied legal talents.
