网络空间下帮助犯罪行为若干问题之研究

Research on Several Problems of Helping Criminal Behavior in Cyberspace

网络空间下帮助犯罪行为的发生日益频繁,但传统刑法学上的共犯理论尚不能妥善处理日益纷繁复杂的网络帮助犯罪行为。此种情形下,对网络空间下帮助犯罪行为的研究很有必要。《刑法修正案(九)》新增的帮助信息网络犯罪活动罪并非对网络犯罪帮助行为以正犯标准进行处罚,而仅是对上述行为进行处罚时的量刑规则。帮助信息网络犯罪活动罪的设立亦为中立帮助行为的定罪处刑提供法律依据。

The crime of helping criminals happens frequently in cyberspace,but the theory of accomplice in traditional criminal law can not deal with the increasingly complicated network to help crime.In this case,it is necessary to study criminal behavior in cyberspace.The crime of cyber-crime added in the amendment to criminal law(nine)does not punish the principal of the crime of cyber-crime by the standard of principal offender,but only the sentencing rules when punishing the above acts.Providing a legal basis for the establishment of the information network to help crime crime is also a neutral help behavior conviction and punishment.
