摘要
通过研究储备新规对土地市场的影响,阐述武汉市土地交易制度的建立和发展,提出储备新规下委托交易制度的作用和意义。研究认为:国家对土地储备摆出了"收"的姿态,武汉市以"原用地单位可以依法公开交易"为核心的委托交易制度,能够精准契合无法及时收购、优先购买或收回的存量土地交易业务,减少土地储备机构的资金压力,加快城市功能更新,弥补土地储备预算管理的短板,维护土地市场的"公平、公正、公开"秩序。要从坚持储备优先,确保垄断土地一级市场;运用委托交易,健全完善配套机制体制;综合储备委托,市场决定存量土地配置等三个方面入手,使委托交易衔接储备新规,促进储备新规下存量土地的市场化配置。
By studying the influence of the new land-reserve regulations,this paper expounds on the establishment and development of the land transaction system in Wuhan and assesses the function and significance of this system under such regulations.According to research,the state has declared"the deflation"of the land reserve.As a result,the land-transaction system in Wuhan has been affected in a variety of ways(e.g.,reduced financial pressure on land reserve institutions,rapid urban function renewals,land-reserve budget allocation management,and maintaining the order of the land market as"fair,just,and open").The land transaction system in Wuhan accurately fits the requirement to ensure a land-market monopoly and to promote the marketization and allocation of stock land.
