摘要
通过定量经济成本分析法分析集体经营性建设用地使用权流转在现有规则下供需双方交易成本,对集体经营性建设用地使用权流转规则做出调整提供科学依据。结果表明,当前集体经营性建设用地使用权流转规则下流转成本过高,流转过程耗时长等导致供需双方交易风险成本较大。因此,需要简化集体经营性建设用地使用权流转程序,提高集体经营性建设用地使用权交易过程中的公开公平与公正,完善集体经营性建设用地使用权交易的法律法规,加强监督管理,减少交易潜在风险成本。
By means of quantitative economic cost analysis the transaction cost of the circulation of collective owned construction land use right(CCOCLUR)on both sides of supply and demand under the current rules was analyzed to provide scientific foundation for enhancing benefits and improving management on CCOCLUR in the future.The results indicate that under the current rules,the main factors that affect the efficiency of CCOCLUR include high transfer costs,and time-consuming circulation procedures,which result in greater cost of transaction to both sides of supply and demand.So it is necessary simplify the procedure of collective management construction land use right transfer.There is also a need to improve the open and equity and justice in the process of collective construction land use right transfer,to improve laws and regulations on CCOCLUR,to strengthen supervision and management,and to reduce the potential risk cost of transaction.
