《管子》的法治思想及其现代化——兼与儒家、墨家、道家治国思想比较

法治思想在《管子》中占有重要份量,包含了法、术、势思想,法的各个要素,法与经济、法与国家、法与百姓、法与无为、法与道德之间的关系,以及根本法与部门法的具体规定等。这套完整的法治体系,上承商鞅,下启韩非,取道家的自然观而不绝礼弃学,取法家的重型理论而不否定德礼教化,取儒家的伦理道德而不法古守旧,开创了"以法治国"理念的先河。《管子》的法治思想具有独特性,尤其是关于道义与法律的观点、法立令行等思想,对我国当前实施的"依法治国"战略具有一定的借鉴意义。

The idea of rule of law occupies an important part in“Guan Zi”,containing the ideas of law,technique and potential,the various elements of laws,the relationship between law and economy,state,common people,inaction,and morality,and the specific provisions of basic law and sector law,etc.This complete legal system,from SHANG Yang to HAN Fei,takes the Taoists’views of nature without leaving school,takes the heavy-duty theory of the Legalist without negating moralization,takes the ethics of Confucianism without adhering to past practices,and creates a precedent for the concept of“rule of law”.The rule of law in“Guan Zi”has a unique characteristic,in which the idea of morality and law,law making and order issued and so on can be used for reference in China’s current“rule of law”strategy.
