法制视角下“高校去行政化”革新途径

Innovation Way of “De-administration in Colleges and Universities” under the Perspective of Legal System

《中华人民共和国高等教育法》明确规定大学是独立法人,依法自主办学,实行民主管理。但是与法律规定相背离的是,高校行政化趋势日益明显。《国家中长期教育改革和发展规划纲要(2010—2020年)》也明确提出"推进政校分开,管办分离""逐步取消实际存在的行政级别和行政化管理模式"。从国家法制层面及政策导向上看,推进高校去行政化势在必行,文章主要从法律层面探讨高校去行政化的必要性,并提出解决高校去行政化的对策建议。

It has been clearly defined in“Higher Education Law of People’s Republic of China”that a university is an independent legal entity,which can run a school independently according to law and implement democratic management.However,contrary to the legal provisions,the trend of university administration has become increasingly obvious.It has also been stated in“Planning Outline of National Medium and Long-term Education Reform and Development(2010-2020)”to“promote the separation of politics and school,separate the operation and management”,and“gradually abolish the actual administrative level and administrative management mode”.From the aspect of national legal system and policy orientation,it is imperative to promote the de-administration of colleges and universities.The author discusses the necessity of de-administration in colleges and universities from the legal aspect and proposes the relevant countermeasures and suggestions.
