中国环境法治中的政党、国家与社会

The Political Party,the State and the Society in the Environmental Rule of Law in China

十八大以来的生态文明建设极大地推动了我国环境法治的发展,但与环境法治实践取得极大进步相对照,环境法治研究则存在"理论虚置""解释乏力"现象。政党、国家、社会是影响中国环境法治的核心要素,马克思主义视野下的"政党—国家—社会"关系决定了中国环境法治的基本架构、塑造了中国环境法治的理论内核。在马克思主义"政党—国家—社会"的理论框架下,当代中国环境法治以"保障和改善民生"为价值诉求,以国家环境保护义务的履行和实现为核心内容,通过授权和委托实现法律制度创新。环境政策法律化现象和环境公益诉讼制度变革中所出现的一些矛盾,在这一理论框架中可以得到更合理的解释。马克思主义基本原理与中国现实相结合,有助于形成具有中国特色的环境法理论体系、制度体系、话语体系。

The construction of ecological civilization since the 18th CPC National Congress has greatly promoted the development of environmental law in China.However,compared with the great progress in environmental law practice,the research on environmental law has been characterized by“theoretical non-performance”and“weak interpretation”.The Party,the state and the society are the core elements affecting the environmental rule of law in China.From the Marxist point of view,the“Party-state-society”relationship determines the basic framework and shapes the theoretical core of China’s environmental rule of law.Within this theoretical framework,the environmental rule of law in contemporary China,which takes the“protection and improvement of people’s livelihood”as its value pursuit and the fulfillment and realization of the State obligations of environmental protection as its core content,can realize institutional innovation through authorization and entrustment and more reasonable explanations can be given to the phenomenon of environmental laws functioning increasingly like policies and the problems arising from the reform of the system of environmental public interest litigation.The combination of the basic principles of Marxism and Chinese realities is conducive to the formation of the theoretical system,the institutional system and the discourse system of environmental law with Chinese characteristics.
