依法处理住宅质量投诉的探究

摘要 住宅质量投诉本质上可分为质量保修和关于销售合同的质量争议两部分,通过向行政部门投诉不可能解决合同争议,必须通过法治、市场、行政等渠道解决。现有的法规不能指导质量投诉的妥善处理,应建立有法可依、有市场手段可用、有行政手段参与的更完整的处理机制。制定和完善法规文件,细化住宅销售合同约定,利用仲裁、诉讼手段、行政调解等途径解决投诉处理。 Residential quality complaints,in essence,can be divided into the warranty of quality and about the quality of the sales contract dispute,it is impossible to resolve the contract dispute by complaining to the administrative department,it must be solved through legal,market,administration and other channels.Existing regulations cannot guide quality complaints properly handle,we shall establish laws and methods available in the market,and there should be more complete processing mechanism of administrative means to participate in.Formulate and improve laws and regulations documents,detailed housing sales contracts,use the means of arbitration and litigation,administrative mediation and other ways to solve the complaint handling.
