摘要
分享经济时代的到来,创造了新的商业模式。以滴滴出行为代表的分享经济平台迅速发展,颠覆了整个出租行业,不仅益于出行解决就业问题,而且真正实现了供需的均衡匹配。随之服务过程中出现交通事故却无处追责等事件层出不穷,也对传统的劳动关系和社会保障制度都提出了挑战。本文以滴滴出行为例,在探析分享经济下新型用工模式劳动关系与传统劳动关系矛盾的基础上,提出相关建议,以期更好的顺应新商业模式的发展需要。
Coming of Sharing economy has created a new business mode.The rapid development of the sharing economic platform,represented by Didi Chuxing,subverts the whole rental industry,not only to serve solving the problem of employment,but also to realize the balance of supply and demand.However,there are endless challenges such as nowhere to claim the responsibility after traffic accidents in the service process,which challenges traditional labor relations and social security systems.On the basis of analyzing the contradiction between the labor relations and the traditional labor relations under the sharing economy,this paper puts forward some suggestions in order to better comply with the development needs of the new business model.
