我国高校科研数据共享中的知识产权与利益协调机制

Intellectual Property Rights and Benefit Coordination Mechanism in Scientific Research Data Sharing in Chinese Universities

本文通过识别我国高校科研涉及的利益主体,总结出科研数据共享涉及直接利益层、间接利益层(影响层与协助层)两个层次的利益主体,并将其与科研数据共享流程相结合,据知识产权相关法律总结出我国高校科研数据共享中存在的知识产权问题,最后提出相应的知识产权利益协调机制。

This paper identifies the interest subjects involved in scientific research in universities in China and sums up two main interests of direct interest and indirect interest(influence and assistance)that combined with the scientific research data sharing process,and the problems of scientific data sharing in universities in China according to the relevant laws of intellectual property.Finally,corresponding coordination mechanisms for interests of intellectual property rights have been proposed.
