论警察执法过程中非致命武力的使用

On the Use of Non-lethal Forces in Police Law Enforcement

武力使用是国家赋予公安机关的职权,使用得当可安定社会、造福人民,使用不当则社会恐慌、民心不稳。公安机关处理案件最常用的手段就是使用非致命武力控制现场、制服嫌疑人,非致命武力的使用也是社会各界关注的热点。一线执法过程中,公安民警非致命武力使用的法治原则、适度原则、程序法定原则是使用武力的三个基本原则。但警察在非致命武力使用时却面临着种种困境,需要通过完善立法、加强民警武力使用培训、树立民警武力使用良好形象等措施来应对现阶段的困境,保障警察依法履行职责。

The use of force is the authority given by the state to the public security organs.When used properly,it can stabilize the society and benefit the people.If it is used improperly,the society will panic and people will be unstable.The most common method used by police when handling cases and control the suspects is the use of non-lethal force,and it is also the focus of attention of all sectors of society.In the process of front-line law enforcement,the principle of the rule of law,proportionality and procedures statutory are the three basic principles of the use of non-lethal force.However,the police are faced with various difficulties in the use of non-lethal force.They need to improve the legislation,strengthen the use of civilian police force training,establish a police force to use a good image and other measures to deal with the current predicament,and ensure that the police perform their duties according to law.
