论我国司法救助制度演变及其立法构想

On the Evolution of China's Judicial Assistance System and Its Legislative Conception

文章回顾了我国司法救助制度形成和发展历程,分析了当前司法救助制度存在的问题,从确定经济困难、厘定审判救助中社会福利机构的范围、统一司法救助程序、规定司法救助的救济权等四个方面提出了立法建议。

The paper recalls the formation and development of China’s judicial assistance system,and analyzes the existing problems of current judicial assistance system.It makes legislative recommendations from four aspects:defining the economic difficulties;determining the scope of social welfare institutions that offer assistance;unifying judicial assistance procedure and stipulating the right of relief of judicial assistance.
