依法构建野生动物及制品专用标识管理制度的思考

Thoughts on Establishing a Management System of Special Identification for Animals and Products in Accordance with the Law

2016年7月2日,十二届全国人大常委会第二十一次会议审议通过了《中华人民共和国野生动物保护法》修订案,明确了对国家重点保护野生动物及其制品实行专用标识管理的法律要求。本文在深入分析野生动物利用现状、存在问题的基础上,借鉴国际上对野生动物及其制品实行专用标识管理的一些做法,结合国内野生动物及其制品经营利用管理专用标识试点取得的经验,从设立野生动物及其制品专用标识制度的基本要求入手,对依法建立野生动物及制品专用标识管理制度较为系统地提出了相应建议。

The amendment of the Wildlife Conservation Law of the People s Republic of China passed by the 21 st session of the 12 th NPC Standing Committee July 2,2016 clarified the legal requirements for implementing special identification management for nationally protected animals and products.Drawing on international experience of and practice in special identification management for animals and products,and combining with the experiences obtained from pilot projects in China,I began from the basic legal requirements for setting up the identification system for animals and products and I referenced the in-depth analysis of animal utilization status and problems.Based on this foundation,I offer suggestions in accordance with the law for establishing the special identification management system.
