诊所法律教育本土化研究——基于认知学习理论 被引量:1

摘要 源于美国的诊所法律教育课程是培养学生法律实践能力的优良教学手段,同时也是为社会提供法律援助、化解社会矛盾的有效途径。然而,诊所法律教育引入我国近20年来,"水土不服"的现象十分严重,很多曾经开课的高等院校逐渐压缩甚至删除了该课程。认知学习理论描述了学习者学习实践能力的基本过程,为诊所法律教育的本土化探索提供了理论模型。运用认知学习理论分析诊所法律教育课程的本土化问题,能够为我国的诊所法律教育建构适当的运行机制。据此,依照我国现行《民事诉讼法》关于公民代理的相关规定提出具体相关对策并普遍推行,方能通过诊所法律教育的本土化手段,兼顾高等院校法科学生的实践培养与社会法律援助的有效供给。 The clinical legal education course deriving from the United States is an excellent teaching method to train students'legal practical ability,and it is also an effective channel to provide legal aid and defuse social contradictions.However,the phenomenon of"acclimatized"is still very serious,since it has been introduced into our country for nearly 20 years.Many colleges and universities once offered have gradually compressed or even deleted the course.Cognitive learning theory describes the basic process of learners'learning practice ability,and provides a theoretical model for the localization exploration of clinic legal education.The application of cognitive learning theory to analyze the localization of the clinic legal education curriculum can build a proper operating mechanism in China.Accordingly,in accordance with China's current“Civil Procedure Law”relevant provisions on citizen agency put forward specific measures and implementation of universal,can we through the localization of clinical legal education,take into account practical ability training of law students of colleges and Universities and the effective supply of social legal aid.
