用现行民法规则解决人工智能法律调整问题的尝试

An Attempt to Solve the Problems of Legal Adjustment of Artificial Intelligence with Current Civil Law Rules

人工智能技术的迅猛发展和广泛应用带来了一系列需要民法解决的问题,如人工智能机器人的法律地位,其行为的性质、责任归属和危险防范等。对于这些问题,究竟是采用新的民法规则解决,还是在现行民法的基本理念和基本规则的范围内寻求解决方法,存在不同看法。以人工智能机器人的民法地位和自动驾驶机动车交通事故责任规则为例进行分析可以得出,在现行民法的基本理念和基本规则的范围内尝试解决上述问题是可行的。因为人工智能技术的发展和应用所提出的问题,现行民法的基本理念和基本规则都是可以应对的,不必改变民法的基本理念和基本规则而另去寻找新的解决办法。

The rapid development and extensive application of artificial intelligence technology have brought a series of problems that need to be solved by the civil law,such as the legal status of artificial intelligent robot,its behavioral nature,attribution of responsibility,and hazard prevention.Considering these issues,there are different views on whether resolving these issues with some new civil rules or the solutions should be sought within the scope of the basic concepts and basic rules of the current civil law.Taking the civil status of artificial intelligence robots and the traffic accidents rules of autonomous vehicles for example,we can propose that it is feasible to try to solve the above problems within the scope of the basic concepts and basic rules of current civil law.That is because the issues raised by the development and application of artificial intelligence technology can be solved with the basic concepts and basic rules of current civil law and there is no need to change the basic concepts and basic rules of civil law to seek new solutions.
