论矿产资源产权法律意识和制度选择

Legal Awareness and System Option with Regard to Property Right of Mineral Resources

对矿产资源集中统一管理,提高资源利用效率,是中国特色社会主义市场经济和全面推进生态文明建设条件下资源与环境协调发展的重要内容。文章从矿产资源产权制度发展历史和逻辑角度,分析了矿产资源产权制度存在的历史必然性、发展趋势和制度逻辑;针对当前我国矿产资源法律制度在产权意识和制度设计逻辑关系上的突出问题,从明确矿产资源产权法律制度主体地位,区分行政许可的资源配置和产权约束功能等方面,提出了完善矿产资源法律制度的思路和相关建议。

Implementing centralized and unified management of mineral resources and raising our capacity to make full use of accessible resources constitute important aspects of resources and environment coordinating development on the basis of the socialist market economy with Chinese characteristics and promoting all-round ecological progress.This paper analyses the historical inevitability of the existence of the property right system of mineral resources,development trends and institutional logic from the perspective of the development history and logic of the property right system of mineral resources.In the light of prominent problems that we face in the logical relationship between the consciousness of property right and system design regarding China's current legal system for mineral resources,this paper offers some ideas and recommendations required for improving the legal system for mineral resources.These include:clearly defining the dominant position for the legal system of mineral resources property rights;distinguishing the allocation of resources under administrative license and the function of constraint of property rights.
