A Study on the Meaning and Basic Characteristics of Essentially Derived Variety

依赖性派生品种在我国现实中已经大量地存在,也已经成为我国立法中重点关注的内容,但是,对于它的含义、术语的称谓和基本特性的研究还不够透彻,对于有些问题人们还普遍存在着模糊的认识。在此情况下,文章对依赖性派生品种的含义和所涉及的基本问题进行了分析和讨论,梳理了一些专业术语的称谓和含义,分析了依赖性派生品种所内涵的基本法律关系和基本特点,提出了认定依赖性派生品种的参照标准。

Essentially derived varieties have already existed in China and have become the focus of the legislation.However,the research on its meaning,terms and basic characteristics is not thorough,and the understanding over some aspects of it is still vague.The paper discusses the meaning of essentially derived varieties and the relevant basic issues,sorts out the titles and meanings of some terminologies,analyzes the basic legal relationships and characteristics of the essentially derived varieties,and puts forward a reference standard for identifying the essentially derived varieties.
