Refutation of the Copyright of Artificial Intelligence in literary Creation

尽管人工智能已经涉足人类的多类智力领域,但迄今为止并未真正进入文学创作领域。从对"微软小冰"诗集等人工智能现象的分析可以看出:首先,人工智能的机理决定了其在创作中缺乏文学所必不可少的"人类情感";其次,人工智能"作品"在构成上存在无法克服的创作主观意志上的缺陷;再次,人工智能"作品"在权利归属上的障碍无法逾越。究其本质,科学技术的发展,并不能使人工智能的创作成果自动获得社会性,而这,在文学创作上凸显的更为明显。换言之,离开人类的创作参与,单纯的人工智能"创作"并不能自动产生文学作品。

Although artificial intelligence has been involved in many kinds of human intelligence fields,it has not really entered the field of literary creation so far.From the analysis of"Microsoft little ice"poems and other artificial intelligence phenomena,it can be seen:firstly,the mechanism of artificial intelligence determines the fact that it lacks the necessary human emotion in literature creation.Secondly,artificial intelligence works have insurmountable defects in the“will”to create.Thirdly,the obstacle of artificial intelligence works in the ownership of rights cannot be surmounted.In essence,the development of science and technology cannot make the creation of the artifici al intelligence automatically acquire sociality,and this is more obvious in literary creation.In other words,without the parti cipation of human beings,pure artificial intelligence creatio n cannot automatically produce literary works.
