摘要
国有企业改制对于我国经济发展具有重要意义。国有企业成立时间长,职工人数多且构成较为复杂,在国有企业改制中职工权益的保护具有复杂性和艰巨性。应区别国有企业改制的类型和可能给职工权益造成的损害,采用不同的方式保障职工在改制中的知情权、参与权、劳动权。同时,强化企业决策机构的法律责任,加强企业内外监督机构的监督,及时化解改制中的劳动纠纷,以维护职工当前和长远的劳动权益。
State-owned enterprises reform is substantially important for our economy development.But because of its long-lasting existence time and vast as well as complex staff members,it is extremely complicated and difficult to ensure staff’s rights and interests during the reform.Therefore,we should distinguish different types of these enterprises reform and figure out potential harm for staff’s rights and interests,adopting different methods to guarantee their rights to know,to participate as well as their labor rights.In the meantime,we need to improve the legal responsibility of corporations decision institutions,strengthen the effect of corporations supervision organizations and solve labor conflicts in reform in time to safeguard staff’s current and long-term labor rights and interests.
